This policy explains how we handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs) and applicable Queensland laws including the Information Privacy Act 2009 (Qld) where relevant.

Although small businesses with an annual turnover under $3 million may be exempt from parts of the Privacy Act, Topbuild has chosen to handle personal information in line with the APPs as a matter of good practice and trust.

We may collect the following personal information when you engage with us:

• Name, email address, phone number and postal address;
• Project address, site details, plans, drawings and photographs;
• Approximate budget, project type and stage of planning;
• Correspondence, enquiry messages and meeting notes;
• Information provided by your architect, designer, engineer, certifier, financier or other consultant relevant to your project;
• Limited financial information necessary to issue contracts, invoices and progress claims (e.g. names on contracts, billing details);
• Technical data when you visit our website (e.g. IP address, browser type, pages visited) collected via standard web analytics.

We do not knowingly collect sensitive information (such as health, racial or political information) and ask that you do not provide it to us.

We collect personal information directly from you whenever possible, for example, when you submit an enquiry through our website, contact us by phone or email, meet with us on site, or sign a contract. We may also receive information from third parties involved in your project (such as your architect, draftsperson, engineer, certifier or QBCC) where this is necessary to deliver our services.

We use personal information to:

• Respond to your enquiry and provide quotes or proposals;
• Prepare and administer building contracts (including QBCC contracts);
• Coordinate with consultants, certifiers, suppliers and trades on your project;
• Manage construction, inspections, defects liability and warranty obligations;
• Issue invoices and process payments;
• Comply with our legal and regulatory obligations under the Queensland Building and Construction Commission Act 1991 (Qld) and other applicable laws;
• Improve our services and, where you consent, send occasional updates about our work.

We only disclose personal information where necessary to deliver your project or where required by law. This may include sharing information with:

• Subcontractors, trades and suppliers engaged on your project;
• Architects, draftspersons, engineers and private certifiers;
• The Queensland Building and Construction Commission (QBCC);
• Insurers, including QBCC Home Warranty Insurance;
• Our accountants, lawyers and professional advisers;
• Government bodies, courts or regulators where disclosure is required or authorised by law.

We do not sell personal information and we do not share your budget or commercial details with trades or suppliers in a way that could inflate pricing.

Personal information is stored in secure cloud-based and physical systems. We take reasonable steps to protect information from misuse, interference, loss, unauthorised access, modification or disclosure. Access is limited to staff and contractors who need the information to do their job. Data may be stored on servers located in Australia or overseas (typically with reputable cloud providers); where information is held overseas, we take reasonable steps to ensure it is handled consistently with the APPs.

We retain project records, contracts and related personal information for as long as necessary to meet our legal, contractual, warranty and tax obligations, typically a minimum of seven (7) years from the completion of works, or longer where required by law. When information is no longer required, we destroy or de-identify it securely.

You can request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete or misleading. To make a request, contact us using the details below. We will respond within a reasonable timeframe and may need to verify your identity before releasing information.

Our website may use cookies and basic analytics to understand how visitors use the site and to improve performance. You can disable cookies through your browser settings, though some parts of the site may not function as intended.
